Acceptable Use Policy

By registering to use services provided by OFX, you agree to comply with the terms and conditions of this Acceptable Use Policy.

You may not use OFX services in connection with any activity, product, service, or transaction that violates any law, government regulation or promotes or facilitates the violation of any law or regulation. Additionally, you may not use the OFX service in connection with any of the following categories of businesses and commercial practices. The types of businesses listed below are representative but not exhaustive. If you are uncertain as to whether your transaction is prohibited by OFX or have questions about how these requirements apply to you, please contact us as follows –

Financial and professional services that are prohibited by OFX or by our financial partners

Financial Firms, Investment & credit servicesHigh Risk or unregulated lending or investment firms, FX Exchanges, Shell Banks or banks with no physical presence in any country, Payday Loan Companies, mortgage consulting or debt reduction services; credit counseling or repair, collection agencies
Money Service Businesses and IntermediariesProviding correspondent services to other financial institutions’ clients, including making payment through pooled accounts held at other payment service providers/money transmitters.
Cash Intensive BusinessesPrivate ATM service providers; Bail bonds; Pawnshops including Cash for Gold type of businesses; Cash advance services.
Prohibited BusinessesAny legal entity designed to provide anonymity and/or issues bearer negotiable instruments (Bearer Shares), shell corporations, or operate as a multi-level marketing/referral marketing firm. Trust and Corporate service providers that are involved in opening accounts on behalf of other businesses, Offshore company formation, or establishing/serving as nominee directors and/or shareholders
Virtual currency or stored valueVirtual currency dealers and exchanges, and businesses involved in the direct issuance, brokerage or sale of virtual currency, or otherwise dealing in virtual currency that can be monetized, resold, or converted to physical or digital products and services or otherwise exit the virtual world (e.g., Bitcoin); sale of stored value or credits maintained, accepted and issued by anyone other than the seller.

IP Infringement regulated or illegal products and services.

Intellectual property or proprietary rights infringementSales, distribution, or access to counterfeit music, movies, software, or other licensed materials without the appropriate authorization from the rights holder; any product or service that directly infringes or facilitates infringement upon the trademark, patent, copyright, trade secrets, or proprietary or privacy rights of any third party; use of OFX intellectual property without express consent from OFX; use of the  OFX name that marks inconsistent with any of OFX’s terms and conditions or in a manner that otherwise harms OFX or the OFX brand; any action that implies an untrue endorsement by or affiliation with OFX.
Counterfeit or unauthorized goodsUnauthorized sale or resale of brand name or designer products or services; sale of goods or services that are illegally imported or exported, or related to the illegal animal/animal part trade, or illegal hunting or fishing.
Gambling
 
Casinos, lotteries (including the sale of lottery tickets); online gambling (including poker), games of chance (including sweepstakes and raffles), sports forecasting, fantasy sports leagues with cash prizes or odds-making.
Prohibited products or services Unlicensed/unregistered non-profits/charities; pharmacies that operate solely via online or mail order; adult visual content, services sexual in nature, or other sexually oriented establishments; military grade weapons and munitions, gunpowder and other explosives, and arms dealers; any involvement with uranium enrichment (even where intended for fuel reactors); toxic, flammable, and radioactive materials; or any products and services with varying legal status on a state-by-state or international basis that OFX deems unable to service including surrogacy services.
NarcoticsIllegal drugs, controlled substances (excluding those sold by licensed pharmacies that are not otherwise prohibited), production, distribution, testing, and/or sale of federally illegal cannabis, or any substances designed to mimic illegal drugs.

Unfair, predatory, or deceptive practices

Ponzi or get rich quick schemesIncludes information guides, warranty fees, credit repair companies, mortgage reduction services, and any product or service where a prize is guaranteed, marketing media is unavailable, premiums/incentives are offered, promises of future guaranteed results are made, or any rebate or reward program.
Predatory practicesIncludes subscription merchants, telemarketing, multi-level marketing, “up-sell” merchants, infomercial merchants, and rebate-based businesses.
No-value-added servicesSale or resale of a service without added benefit to the buyer; resale of government offerings without authorization or added value; sites that we determine in our sole discretion to be unfair, deceptive, or predatory towards consumers.

If we believe, in our sole discretion, that you have engaged in any violation of this Acceptable Use Policy, we may (with or without notice to you) take such actions as we deem appropriate to mitigate our risk and any risk to third parties. Such actions may include but are not limited to blocking the settlement or completion of a money transfer; suspending, restricting or terminating your access to our services; taking legal action against you; and/or terminating our business relationship with you.

This Acceptable Use Policy may be amended by OFX from time to time by posting a new version of it on our website. By accessing and using our services after a new version is posted, you agree to all amendments therein.
